Stark Watch ("we", "us", "our") operates the website starksfinework.com. This policy explains what personal information we collect, why we collect it, and what you can do about it. We process personal information in accordance with South Africa's Protection of Personal Information Act, 2013 (POPIA).

2. What we collect

Information you give us directly. When you submit our contact form, we collect your first name, last name, email address, and the content of your message. If you email us instead, we receive whatever you choose to include in that email.

Information collected automatically. When you visit the site, our hosting provider and any analytics tools record technical data such as your IP address, browser type and version, device type, approximate location (derived from IP), pages viewed, time spent on pages, and the site or link that referred you.

Information about inquiries and commissions. If your inquiry progresses to a commission or purchase discussion, we may collect further details you provide — such as a phone number, shipping address, wrist measurements or specifications, and correspondence about the work.

We do not knowingly collect special personal information (as defined in POPIA), and we do not collect information from children under 18.

3. Why we use it
  • We use personal information to:

    • respond to your inquiry and correspond with you about it;

    • discuss, quote for, produce and deliver commissioned work;

    • keep records of inquiries, orders and correspondence;

    • maintain and improve the website and understand how visitors use it;

    • protect the site against spam, fraud and abuse;

    • comply with legal, tax and accounting obligations.

    Our lawful bases under POPIA are your consent (which you give by submitting the form), the performance of a contract or steps taken at your request before entering one, our legitimate interests in running and securing the business, and compliance with the law.

4. Marketing

We do not add you to a mailing list simply because you contacted us. If we ever introduce a newsletter or send updates about new work, we will ask for your consent first, and every message will include an unsubscribe link.

5. Who we share it with

We do not sell or rent your personal information. We share it only with:

  • Our website host and site builder (Hostinger International Ltd.), which hosts the site and processes contact form submissions on our behalf;

  • Our email provider, which stores and delivers our correspondence with you;

  • Analytics providers, if enabled, which process usage data on our behalf;

  • Shipping, courier and customs agents, where delivery of a piece requires it;

  • Payment providers and our bank, where a transaction requires it — we do not store your card details ourselves;

  • Professional advisers and authorities, where we are legally required or permitted to disclose.

6. Cross-border transfers

Some of our service providers store or process data on servers outside South Africa. Where personal information is transferred across borders, we take reasonable steps to ensure it is protected by laws, binding agreements or binding corporate rules that provide a comparable level of protection to POPIA.

7. Cookies and similar technologies

Our website uses cookies — small text files stored on your device. These include:

  • Essential cookies, needed for the site to function and to secure form submissions;

  • Analytics and performance cookies, which help us understand how the site is used;

  • Third-party cookies, set by embedded content (for example, video hosted elsewhere).

You can block or delete cookies through your browser settings. Blocking essential cookies may stop parts of the site working properly.

8. How long we keep it

We keep contact form submissions and correspondence for as long as needed to deal with your inquiry and for a reasonable period afterwards in case you return to it. Records relating to a completed commission or sale are kept for at least five years, as South African tax and company law requires. Analytics data is retained according to the retention settings of the tool used. When information is no longer needed, we delete or de-identify it.

9. How we protect it

We take reasonable technical and organizational measures to protect personal information against loss, unauthorised access and misuse — including encrypted connections (HTTPS), access controls on our accounts, and reputable service providers. No system is completely secure, and we cannot guarantee absolute security. If a security compromise affects your personal information, we will notify you and the Information Regulator as POPIA requires.

10. Your rights

Under POPIA you have the right to:

  • ask what personal information we hold about you and request a copy;

  • ask us to correct, update or delete information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or unlawfully obtained;

  • object to our processing of your information on reasonable grounds;

  • withdraw consent you previously gave, where consent is our basis for processing;

  • ask us not to use your information for direct marketing;

  • lodge a complaint with the Information Regulator.

11. Visitors in the UK and European Economic Area

If you are in the UK or EEA, the UK GDPR or EU GDPR may also apply to our processing of your information. In addition to the rights above, you have the right to data portability and the right to restrict processing, and you may lodge a complaint with your local supervisory authority. Our site may link to or embed content from other websites. We are not responsible for their privacy practices, and we encourage you to read their policies before providing them with personal information.

13. Changes to this policy

We may update this policy from time to time. The current version will always be posted on this page with the date it was last updated. Material changes will be highlighted where practical.
